Cheapsite Terms of Use
Last Revised: March 25, 2025
Welcome to Need A Cheapwebsite’s Terms of Use! We are truly excited to have you aboard. Thank you for choosing to use our services.
Below we have listed important legal terms that apply to anyone who visits our website or uses our services. These terms are necessary in order to protect both you and us and to make our services possible and more enjoyable for everyone. Need A Cheapwebsite offers a wide range of services and features, and part of the terms below may not be relevant to the specific services you use.
We understand that legal terms can be exhausting to read, and we’ve tried to make the experience more pleasant. If you have suggestions on how we can improve them, you are welcome to contact us at support@cheapsite.dev.
1. Introduction
Welcome to Need A Cheapwebsite, operated by Cheapsite. These Terms of Service (“Terms”) constitute a binding legal agreement between you and Cheapsite governing your access to and use of our website, products, and services. By accessing or using any portion of our website or services—including web development using WordPress and Divi Builder, our educational courses (DIY, Do-It-Together, and Do-It-For-You), and consultation services—you agree to be bound by these Terms. If you do not agree with these Terms, you must immediately cease using our services.
2. Scope of Services
Cheapsite specializes in providing comprehensive web development services by leveraging industry-standard platforms such as WordPress and ElegantThemes’ Divi Builder. In addition to custom website development, we offer a range of educational courses designed to empower you to build, manage, and maintain your own website. Whether you choose to create your site independently (DIY), collaborate with our experts (Do-It-Together), or delegate the entire process to us (Do-It-For-You), our Services are structured to meet diverse needs while ensuring quality and affordability. Please note that our Services may be modified or updated periodically, and all offerings are subject to the terms set forth herein.
3. User Account and Registration
Access to certain features of our Services requires the creation of a User Account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials, and any activities conducted under your account will be deemed to be your responsibility. In cases where you register through an authorized third-party reseller, these Terms shall govern your relationship with Cheapsite regardless of any separate agreements you may have with the reseller.
4. Payment and Subscription Terms
Payment for our services is required in advance, and prices are as stated on our website at the time of purchase. For recurring subscription-based services, your subscription will automatically renew unless you cancel in accordance with our cancellation policy. It is your responsibility to review the pricing and payment terms applicable to your chosen service package. Any charges incurred are non-refundable as outlined in our Refund Policy. Furthermore, you authorize Cheapsite to charge your designated payment method for all amounts due, and you acknowledge that failure to settle such amounts may result in the suspension or termination of your Services.
5. Website Development and Revision Policy
Cheapsite is committed to delivering high-quality website development services tailored to your requirements. Our process begins with an initial consultation and project scoping, followed by the design, development, and deployment of your website using third-party platforms such as WordPress and Divi Builder. To ensure the final product meets your expectations, we include a comprehensive revision process. Specifically, our standard service package includes two rounds of revisions. These revisions are intended to refine and adjust the website’s design and functionality based on your consolidated feedback. We request that you provide clear, detailed, and consolidated feedback for each revision round so that we can address all concerns efficiently.
Should you require additional revisions beyond the included rounds, these will be billed at a predetermined hourly rate of $150 an hour (USD) or fixed fee, which will be communicated to you in advance. The revision process is time-sensitive, and each round of revisions is scheduled to be completed within an agreed timeframe. If feedback is delayed beyond the agreed period, project deadlines may be extended accordingly. Once the website is approved and marked as complete, any subsequent modifications will be treated as a new service engagement and will be subject to separate fees and agreements.
6. Third-Party Tools and Services
In the course of providing our Services, Cheapsite utilizes, recommends, and integrates various third-party tools and services, such as ElegantThemes’ Divi Builder, Namecheap hosting, plugins, and other related technologies. Although we select these tools based on our professional expertise and in good faith, Cheapsite does not control, endorse, or guarantee the ongoing availability, pricing, or functionality of these third-party services. You acknowledge and agree that any issues arising from the performance, discontinuation, or changes in these tools are solely the responsibility of the respective third parties, and Cheapsite shall not be liable for any such issues.
7. Refund Policy
Due to the nature of our work and the digital delivery of our services, all sales are considered final and non-refundable, unless otherwise explicitly stated. For web development services, once work has commenced or any deliverables have been provided, no refunds will be issued. In the event that a project is canceled before any work has begun, a partial refund may be issued at Cheapsite’s discretion, less any administrative or setup fees incurred. Similarly, all digital courses and educational content are final sales; if you experience technical difficulties, we will provide support to resolve such issues but will not offer refunds after access has been granted.
For subscription services, cancellation is permitted at any time; however, any fees paid for a billing cycle that has already commenced are non-refundable. In exceptional circumstances, Cheapsite may, at its sole discretion, offer a partial refund or credit toward future services. Any dispute or chargeback initiated without prior contact to resolve the issue may result in the termination of your services and the pursuit of legal remedies to recover any outstanding payments.
8. Intellectual Property and Ownership
All intellectual property rights related to the custom work, educational materials, templates, code, and design elements provided by Cheapsite remain the exclusive property of Cheapsite or its licensors. You are granted a non-exclusive, non-transferable license to use the delivered work solely for your own internal business purposes, and you may not reproduce, resell, or redistribute any materials without our express written consent. Content that you upload or create during the course of using our Services remains your property; however, by submitting such content, you grant Cheapsite a limited license to use, display, and distribute it solely for the purposes of delivering the Services.
9. Termination
Cheapsite reserves the right to suspend or terminate your access to our Services at any time, without prior notice, if you breach any of these Terms or engage in conduct that may harm our business or other users. Termination of Services does not absolve you of any financial obligations incurred prior to termination, and any outstanding balances shall remain due. Upon termination, you are required to immediately cease using our Services and any associated materials provided by Cheapsite.
10. Limitation of Liability
To the fullest extent permitted by law, Cheapsite shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to your use of our Services. Our total liability to you for any claims under these Terms shall not exceed the total amount paid by you for the specific Service giving rise to the claim within the preceding 3 months. In no event shall Cheapsite be liable for any loss of profits, loss of data, or other intangible losses, even if advised of the possibility of such damages. If there are losses, those will be capped at $100 (USD) and no more more will be provided.
11. Indemnification
You agree to indemnify, defend, and hold harmless Cheapsite, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your use of our Services, your violation of these Terms, or your infringement of any rights of a third party.
12. Dispute Resolution
Any disputes arising out of or related to these Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or related to these Terms must be brought exclusively in the state or federal courts located in Maricopa County, AZ, and you hereby consent to the jurisdiction and venue of such courts. Prior to initiating any legal action, both parties agree to attempt in good faith to resolve any dispute through negotiation or mediation. In accordance with applicable law and as provided by Arizona law, any disputes arising from these Terms shall be resolved exclusively through binding arbitration rather than through litigation in a court of law. By agreeing to these Terms, you acknowledge that arbitration, or mediation, is your sole and exclusive remedy, thereby waiving your right to a trial by jury and to participate in any class or consolidated actions. This process is designed to be a faster, less formal, and more cost-effective means of dispute resolution, ensuring that any decision reached is final and enforceable.
13. Modifications to Terms
Cheapsite reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically for any updates.
